Terms of service
PredictWithUs is operated by True Olive LLC (“we,” “us”). It helps organizations and individuals raise money with prediction games. By using PredictWithUs, you agree to these terms and to our privacy policy. If you don't agree, please don't use it. We've tried to keep it plain.
“Organizers” create and run games, for an organization or for themselves. “Players” pay an entry fee to make predictions in those games.
Accounts
- We create an account for you the first time you submit a prediction or sign in.
- You must be 18 or older (or the age of majority where you live) to use PredictWithUs. A parent or guardian can enter a game for a child in their care, using their own account, and is responsible for that entry.
- Give us accurate information, keep your sign-in secure, and use one account per person.
If you run games
- You are responsible for your games: the questions, the results, the prizes, and the messages you send.
- Resolve questions honestly and on time, based on what actually happened.
- You are responsible for giving out any prizes you promise, and for any taxes on them.
- Prizes must be non-cash items, perks, experiences, or recognition, within the value limits in the Organizer Agreement. No cash, gift cards, or anything that works like cash, and nothing age-restricted.
- Follow the laws that apply to you, including rules on contests, raffles, and fundraising. It is your job to make sure your game, its entry fee, and its prizes are allowed where you and your players are.
- Running a game also means accepting our Organizer Agreement, which explain how entry fees are shared and paid out.
- If a prize isn't delivered, you owe it to the Player. We may hold your payout or remove you from PredictWithUs until it's sorted out.
- Every game is public: it can be listed on PredictWithUs and appear in search results. Don't put anything in a game that shouldn't be public.
- Don't publish a minor's full name or photo without the consent of their parent or guardian.
- Only invite people you have permission to contact.
- If you run a game for an organization, you must be authorized to act for it.
- If you run a game for yourself and you're under 18, a parent or guardian must hold the account, accept the Organizer Agreement, and receive the payouts.
If you play
- Play fair. No extra accounts, bots, or other ways of cheating.
- The Organizer decides how each question resolves. Their decision is final.
- When players tie for a prize, the one who submitted predictions first wins.
- Prizes come from the Organizer, not from us. Take prize questions to them first.
- Prizes are non-cash items, perks, experiences, or recognition. They can't be exchanged for cash.
- Predictions are for fun and community. They are not financial advice or investments.
Paying to play
- You buy your entry from us. We show you the entry fee, and how much of it goes to the Organizer, before you pay.
- An entry fee is a payment to play a game. It is not a donation, and you can't treat it as a tax-deductible gift.
- Entry fees aren't refundable once you've joined, including before predictions close. We do refund them if the game is cancelled, if every question ends up unresolved, or if the same email has already entered that game.
- If only some questions end up unresolved, the game is scored on the ones that were resolved, and there is no refund.
- If a prize doesn't arrive, the Organizer owes it to you, and we don't refund your entry fee. Please tell us: we may hold the Organizer's payout or remove them from PredictWithUs.
- Your name appears on the game's leaderboard, where other Players can see it.
What's not allowed
- Breaking the law, or helping someone else break it.
- Games or questions that bet on or make light of anyone's death, injury, or illness, or that harass, threaten, or demean people. A game about progress toward a cure or a recovery is fine.
- Rigging a game, or resolving a question in a way you know is false.
- Spam, or collecting other people's information for uses outside the game.
- Hacking, scraping, overloading, or copying the platform.
Your content and ours
- What you create stays yours. You give us permission to host, display, and share it as needed to run your games.
- AI features suggest questions and wording. Suggestions can be wrong, so review them before you publish. You are responsible for what you publish.
- The PredictWithUs platform, name, and design belong to us.
Ending things
- You can stop using PredictWithUs and delete your account at any time.
- We can suspend or close an account, or remove a game, if these terms are broken or if we need to protect players, an organization, or the platform. Where we can, we'll tell you why and give you a chance to fix it.
Our promises and their limits
- We work hard to keep PredictWithUs running well, but we provide it “as is,” without warranties. It may have errors or downtime.
- We are not responsible for what Organizers or Players do, including how a question is resolved or whether a prize is delivered.
- To the extent the law allows, we are not liable for indirect or unexpected losses, and our total liability to you is limited to the greater of what you paid us in the past 12 months or $100. This limit doesn't reduce any payout we owe under the Organizer Agreement.
- If someone makes a claim against us because of your game or because you broke these terms, you agree to cover our costs.
- California law governs these terms. Disputes go to the courts in California. Please email us first; most problems can be fixed with a conversation.
Changes and contact
If we make meaningful changes, we'll update the date above and email account holders before the changes take effect. Using PredictWithUs after that means you accept the new terms.
