Organizer Agreement
These terms apply when an organization or an individual runs a game on PredictWithUs, which is operated by True Olive LLC (“we,” “us”). They add to our terms of service, which still apply. You accept them the first time you publish a game. Where these terms say “your organization,” they also mean an individual running games for themselves.
How the money works
- Players buy their entry to a game from us. We collect every entry fee.
- In return for running the game and sharing it with your community, we pay your organization a share of the entry fees collected.
- Entry fees are payments to play a game, not donations to your organization. Players can't treat them as tax-deductible gifts, and you must not tell them otherwise.
Your share
- Your share depends on the pricing option for the game: 80% on Standard, 85% with the One-Time Fee, and 90% with Membership.
- The One-Time Fee is $49 per game, and we refund it only if the game is cancelled before anyone joins. Membership costs $45 a month. You pay for either by card when you choose it. These costs are never taken out of your payout.
- Membership renews every month until you cancel. You can cancel anytime, and it ends at the close of the month you've paid for, with no refund for part of a month. When you become a Member, your running games with fewer than 50 players move to the 90% share, and games with 50 or more keep the share they have. Those games, and any game published while you're a Member, keep the 90% share until they end, even if you cancel first.
- We pay card processing fees out of our share. They don't reduce yours.
- The pricing option applies to the whole game. If you upgrade before the game has 50 players, your new share applies to every entry fee collected, including ones collected before the upgrade.
- There is no limit on the number of games you can run or the players a game can have. Once a game has 50 players, it can no longer be upgraded.
Getting paid
- A game ends when every question is resolved, or when its resolve-by date passes. We pay your share once, after the game ends, in a single payment.
- To get paid, send us a completed IRS Form W-9 and your payout details within 30 days after the game ends. You can be paid by bank transfer (ACH) to an account in your organization's name, or by check mailed to your organization's address. If you're under 18, we pay your parent or guardian.
- We send your payout within 5 business days after the game ends, or after we receive your details, whichever is later. Bank transfers usually arrive in 1 to 3 business days; checks take longer in the mail.
- If we don't receive your details within 30 days, we may refund the entry fees to players instead, and your organization won't receive a share for that game.
- You're responsible for giving us accurate payout details. We aren't responsible for payments sent to details you gave us.
Refunds and disputes
- If a game is cancelled, or every question ends up unresolved, we refund players their entry fees and there is no share to pay.
- If only some questions end up unresolved, the game is scored on the ones that were resolved. Players aren't refunded, and your share is unchanged.
- Players can't get a refund for changing their mind after joining. If someone enters a game twice with the same email, we refund the second entry and it isn't counted in your share.
- If a player's payment is reversed or disputed with their bank after we've paid you, we may take that amount out of your next payout. If there is no next payout, you owe it to us and agree to pay it within 30 days of our request.
- We may hold a payout while we look into suspected fraud, cheating, or a breach of these terms. We'll tell you if we do.
Taxes
- Your organization is responsible for any taxes on the share it receives.
- We report payments to the IRS where the law requires it, for example on Form 1099, using the details on your W-9.
Prizes
- What a prize can be. A prize must be an item, a perk, an experience, or recognition that you or your organization provides. For example: school or team merch, a signed jersey, a reserved parking spot at the school play, a meet-and-greet, front-row seats, or a shout-out.
- What a prize can't be. Prizes can't be cash or anything that works like cash. That includes gift cards, prepaid cards, store credit, cryptocurrency, raffle or lottery tickets, and anything given mainly to be resold.
- Items you can't offer. No alcohol, tobacco or vaping products, cannabis, weapons, or anything else a player would need to be of age to receive.
- Value limit. Each prize must be worth no more than $100, and all of a game's prizes together no more than $250, at fair retail value. Value prizes honestly: don't inflate a prize to make the game look bigger, or understate it to stay under the limit.
- No cash instead. Winners can't swap a prize for cash, and you can't offer them cash in its place. If you can't deliver a prize as described, replace it with a similar non-cash item of equal or greater value, and tell the winner.
- Describe it accurately. Say clearly what the prize is, how winners get it, and any conditions, like “pickup at the school office” or “valid for the spring play only.”
- Who provides it. You or your organization provides and delivers the prizes, at your own cost, not from the entry fees we hold. We don't. Deliver each prize within 30 days after the game ends.
- If something goes wrong. If a prize isn't delivered, you or your organization owes it to the player. If a prize breaks these rules, we may edit or remove it, pause the game, hold your payout, or remove you from PredictWithUs.
- Taxes. You or your organization is responsible for any taxes or reporting on the prizes you give.
How we describe your cause
- You allow us to use your organization's name and logo on your games and to tell players what part of each entry fee goes to your organization (for example, “$8 of every entry goes to your organization”).
- Tell players accurately what the money supports, and don't promise more than your share.
- Some states have extra rules when a business says part of a sale benefits a charity. If those rules apply, we may ask your organization to sign a separate written agreement before the game starts.
Who can accept
- The Organizer who accepts these terms confirms they are authorized to agree to them for the organization and to receive funds on its behalf. Individuals under 18 can't accept these terms themselves: a parent or guardian accepts them and receives the funds.
Changes and contact
If we change these terms in a meaningful way, we'll update the date above and ask your organization to accept the new version before it publishes another game. Games already running keep the terms they started with.
